FAIR CREDIT REPORTING
ACT DISCLOSURE AND AUTHORIZATION
FOR DRIVER SCREENING AND REFERRAL PURPOSES
1. DISCLOSURE – ROLE OF BENUX CORP
Benux Corp (“Benux Corp,” “Company,” “We,” or “Us”) operates solely as a driver recruiting,
screening, and referral service provider. Benux Corp does not employ drivers, does not act as a
motor carrier, and does not make hiring or employment decisions.
Drivers who submit an application through Benux Corp are being considered for potential
employment with one or more independent third-party motor carriers or transportation companies
(each, a “Prospective Employer”). All employment decisions are made exclusively by the
Prospective Employer.
2. FAIR CREDIT REPORTING ACT DISCLOSURE
In connection with your application to be considered for employment by Prospective Employers,
Benux Corp and/or its authorized Prospective Employer clients may obtain one or more consumer
reports and/or investigative consumer reports (collectively, “Background Check Reports”) from a
third-party consumer reporting agency, as permitted by the Fair Credit Reporting Act (“FCRA”),
15 U.S.C. §1681 et seq.
These reports are obtained solely for driver screening, referral, and employment consideration
purposes.
3. SCOPE OF BACKGROUND CHECK REPORTS (INCLUDES MVR)
Where permitted by law, Background Check Reports may include one or more of the following:
- Motor Vehicle Record (“MVR”) checks from state Departments of Motor Vehicles
- Commercial driver’s license status, class, endorsements, and restrictions
- Driving history, accidents, citations, violations, and convictions
- Criminal background checks
- Employment verification and safety performance history
- Education and credential verification
- Professional license verification
- Reference checks
- Public records searches
A consumer credit report will not be obtained. However, publicly available court records (such as
bankruptcy filings) may appear as part of public-record searches.
4. ADVERSE ACTION NOTICE (FCRA COMPLIANCE)
If a Prospective Employer uses information contained in a Background Check Report, in whole or in
part, to make an adverse employment decision, the Prospective Employer—not Benux Corp—will
provide you with:
- A copy of the report relied upon, and
- A written summary of your rights under the Fair Credit Reporting Act
before taking final adverse action, as required by law.
5. AUTHORIZATION TO OBTAIN BACKGROUND CHECK REPORTS
By signing below, I authorize and instruct Benux Corp, acting solely as a recruiting and
screening service provider, its authorized Prospective Employer clients, and any designated
consumer reporting agency or background check vendor to request, obtain, and disclose Background
Check Reports about me for employment consideration purposes.
I understand that information I provide to Benux Corp may be shared with Prospective Employers
for the purpose of evaluating my qualifications as a commercial driver.
6. MOTOR VEHICLE RECORD (MVR) AUTHORIZATION
I expressly authorize Benux Corp, its authorized Prospective Employer clients, and any designated
background check vendor to request, obtain, and review my Motor Vehicle Record (“MVR”) from any
state Department of Motor Vehicles or equivalent motor vehicle authority.
I understand that my MVR may include information regarding:
- Driver’s license status, class, and endorsements
- Accidents, citations, violations, and convictions
- License suspensions, revocations, cancellations, or restrictions
I authorize such MVR inquiries as required for employment consideration and, if applicable,
during the duration of my employment with a Prospective Employer as permitted by law.
7. FMCSA PRE-EMPLOYMENT SCREENING PROGRAM (PSP) DISCLOSURE
In connection with your application for employment consideration, Benux Corp and/or its
authorized Prospective Employer clients may obtain information from the Federal Motor Carrier
Safety Administration (“FMCSA”) Pre-Employment Screening Program (“PSP”) regarding your
commercial driving safety performance.
Benux Corp acts solely as a facilitator of this process and does not make employment decisions.
If a Prospective Employer uses PSP information to take adverse action, the Prospective
Employer—not Benux Corp—will provide all notices required under the Fair Credit Reporting Act.
8. PSP AUTHORIZATION
I authorize Benux Corp and its authorized Prospective Employer clients to access the FMCSA PSP
system to obtain my:
- Crash data from the previous five (5) years, and
- Roadside inspection history from the previous three (3) years
for employment consideration purposes.
I understand that PSP reports include all reportable crashes and inspections, regardless of
fault, and that Benux Corp cannot modify or correct PSP data.
9. FMCSA DRUG AND ALCOHOL CLEARINGHOUSE – LIMITED QUERY CONSENT
I provide consent to Benux Corp and its authorized Prospective Employer clients to conduct
limited queries of the FMCSA Commercial Driver’s License Drug and Alcohol Clearinghouse to
determine whether drug or alcohol violation information exists about me.
This consent applies for employment application processing and, if hired, for the duration of my
employment with a Prospective Employer, as permitted by law.
10. SAFETY PERFORMANCE HISTORY RELEASE (49 CFR §391.23)
I authorize my previous employers to release safety performance history information to Benux Corp
and/or Prospective Employers as required by 49 CFR §391.23.
I release my previous employers, their officers, employees, and agents from liability for the
lawful disclosure of such information.
11. RELEASE OF LIABILITY
I hereby release and hold harmless Benux Corp, its Prospective Employer clients, background check
vendors, consumer reporting agencies, and their respective officers, employees, agents, and
representatives from liability arising out of the lawful collection, disclosure, and use of
information obtained pursuant to this authorization.
12. STATE LAW NOTICES
Certain state laws, including but not limited to California, Minnesota, and Oklahoma, require
additional disclosures regarding investigative consumer reports. Such notices apply where
legally required and are incorporated by reference into this authorization.
13. AUTHORIZATION VALIDITY
This authorization shall be valid in original, electronic, scanned, faxed, or photocopied form
and may be relied upon by Benux Corp and its authorized Prospective Employer clients.
